Compliance with Article 9 of Aarhus Convention on access to justice.
The Aarhus Convention is an environmental treaty signed by the UK in 2005 which guarantees the rights of the public to participate in democratic processes relating to environmental matters. Article 9 of Aarhus Convention requires access to justice to be ‘fair, equitable, timely and not prohibitively expensive.’
Analysis by the Environmental Rights Centre for Scotland (June 2026) has found that Scotland remains non-compliant with Article 9.
